Our Services and Products

SDZ Loungewear Ltd displays Products for sale provides Services and charges the prices shown on our Site. The Site Visitor or Customer chooses a Product and pays for it following our payment terms and online payment process. The product is sent to the Customer using their chosen method of delivery.

Definitions

The terms “we”, “us”, and “our” refer to SDZ Loungewear Ltd. The terms “user”, “you”, and “your” refer to site visitors, customers, and any other users of the site.

The term “SDZ” or "SweetDreamz By MKB" refers to SDZ Loungewear Ltd the company who owns and runs this website and provides Products and Services.

The term “Service” or “Services” refers to the Services we provide on this Site such as displaying Products for sale, providing payment methods and information about Products.

The term “Site” refers to the SweetDreamz By MKB website www.sweetdreamzbymkb.com

The term “Product” or “Products" refers to the items available for sale on our Site. In some cases, “Product” may also mean the plural Products or the other way round.​

The term “Visitor” means anyone who visits or browses our Site.

The term “Customer” means a Visitor to our Site who intends or has bought one of the Products on display on our Site.

Using our Site

To access or use our Site, you must be 16 years of age or older and have the necessary power and authority to enter into these Terms and Conditions. Children under the age of 16 are prohibited from using the Site. Information provided on the Site and in the Service related to Products for sale or their description or any other information is subject to change. SweetDreamz By MKB makes no representation or warranty that the information provided, regardless of its source (the “Content”), is accurate, complete, reliable, current, or error-free. SweetDreamz By MKB disclaims all liability for any inaccuracy, error, or incompleteness in the Content.

1. Payment and Charges

You agree to pay all costs and charges related to the Products and Services you have ordered set out on our website and to use the appropriate payment facilities and processes presented on our Site. Prices and costs may change from time to time in the normal course of business practice.

2. Buying Process

You agree to follow our processes and procedures for buying Products. You may need to register for an account with us before you order. Then after selecting the Products you want, you select “Basket” and proceed to the checkout where you will need to fill out a form with address and payment details and then pay for the Product using a credit or debit card or facilities such as PayPal. You agree and acknowledge that placing an order means you are obliged to pay for the items you have ordered. After payment is received you will get confirmation that we have received your order. You will then receive confirmation when your order has been dispatched containing delivery details.

3. Delivery

All Products will be delivered to you by “UK Mailing Service” who are a company specialising in delivery service. You agree to pay the shipping cost which is displayed when you place the order. Title to the Products will pass to you the moment the Product is dispatched to your address and by placing an order you agree that a third-party delivery service will be used.

4. Our Agreement

Your order is an offer to SweetDreamz By MKB to buy the Products you have ordered. When you place an order to buy Products from us, we will send you an e-mail confirming we have received your Product Order. It is not acceptance of your order, but only confirms that we have received your order, we accept your offer to buy the Product when the Product is dispatched to you, it is at this point that a contract is made between SweetDreamz By MKB and you. You will then get an email confirming when the Mailing Service has sent your Product.​

5. Quantities

We only sell Products in quantities which correspond to the needs of a typical average household. It applies to either Product ordered singly or multiple orders. It means that you cannot bulk buy Products unless you contact us before you order.

6. Product Colour

The exact shade, colour, size, texture, or construction of finished goods may differ due to the types of materials used, variation in batches or the manufacturing process, therefore, we cannot guarantee that all colours and Products will be the same. Please contact us if you have a question about a Product concerning these issues.

7. Promotions and Discounts

The normal retail price shown on our website may be subject to discounts or "Sale” "Sale Items" "Promotional offers" or "Promotional Discounts". We may also give discounts through third party companies or websites. Such discounts are only valid on Qualifying Products bought using your own credit card and shall not apply to any orders to be charged to another entity or company. Promotional discounts are not valid on bulk orders, previous purchases, or in combination with any other promotion. We may also offer free delivery on some items to some areas or regions when you spend over a specified amount. However, international deliveries require a special tariff and may not be subject to any promotional discount or free delivery. Please see our website for further details.

1. You agree to follow all the conditions applicable to discounted products and to abide by the terms set out by any other authorised website or discount operator. We do not take any responsibility for any non-authorised discounts offered by third parties.

2. You agree we have the right to withdraw any promotional discount or delivery option without notice and to charge the normal retail price shown on our website before the discount was applied.

3. Please check any special conditions which may apply to any promotional discounts which we will display on our website which are a supplement to these terms and conditions.

To use our Service, you may be required to provide information about yourself including your name, email address, username, and password, and other personal information. You agree that any registration information you give to SweetDreamz By MKB will always be accurate, correct, and up to date. You must not impersonate someone else or provide account information or an email address other than your own. You must not use your account for any illegal or unauthorised purpose. You must not, when using our Service, violate any laws in your jurisdiction. Please read our Privacy Policy for more information on your personal data.

9. Brands and packaging

You are responsible for following all packaging instructions, obligations and warnings. You agree to make sure that you do not infringe the rights of our partners and other third parties. We will not be held liable for any third-party claims from third party claims on this point. You cannot change or alter our brands or mark any of our Products with other brand names or trademarks. You cannot alter or change the Product packaging design or any re-packaging.

You agree to receive sales invoices electronically if applicable which we will send you in PDF format or registered email.​

11. Lawful Purposes

You may use the Site and Service for lawful purposes only. You agree to be financially responsible for all purchases made by you or someone acting on your behalf through the Site. You agree to use the Site and to purchase Services or Products through the Site for legitimate, non-commercial purposes only. You shall not post or transmit any material which violates or infringes the rights of others through our Site.  Or which is threatening, abusive, defamatory, libellous, invasive of privacy or publicity rights, vulgar, obscene, profane, or otherwise objectionable, contains injurious formulas, recipes, or instructions, which encourages conduct that would constitute a criminal offence, give rise to civil liability, or otherwise violate any law.

12. Refusal of Service

We offer our Services subject to our acceptance of your order or requests. We reserve the right to refuse our Services to any order, person, or entity, without having to give a reason for doing so. We cannot accept an order until payment has been processed and received. We may at any times change or discontinue any aspect or feature of the Site or Service, subject to us fulfilling our previous responsibilities to you based on acceptance of your payment. Please note that acceptance of your offer to buy a Product is only made when the Mailing Service dispatches the product.

13. Refunds

The law says that you can return a Product bought online within 14 days after you have accepted delivery of the Product for any reason. However we have extended the period to 28 days. You can ask us for a refund at any time within this period. There are some exceptions, for example, Products made to order. It means you cannot get a refund within the 28-day period because we have made the Products especially for you.

The above also applies to faulty Products, Products not of satisfactory quality or Products which do not match their description on our website. In this situation, you can return the Product within 28 days to us where we will check if the above conditions apply to the Product. If we find that the Product is faulty, not of satisfactory quality or does not match the description we will offer to repair, replace or refund your payment depending on which is applicable. If we cannot find any problems with the Product it will be sent back to you. Please note that you are responsible for paying the cost to send the Products to us.

There may be other express and implied terms which apply to returning products and your consumer rights in general. These are set out in the Consumer Rights Act (2015) and other pieces of legislation which you may refer to.

14. How to send Products back

If you are returning Products for a refund within the 28-day period, we require you to request to return your product via our Returns Portal. UK customer able then able to print out a returns label to send the product back to use. Please make sure you read the following conditions.

• All returned Products must be unworn, unwashed, complete with original tags or packaging.
• You are responsible for paying the direct return shipping or postage costs of the Product.
• All Items must be in an original, resalable condition.
• Please make sure all returned items are well packed to avoid damage in transit
• Please use a trackable insured service when posting any items
• We are not liable for items damaged or lost in return transit.
• We are not able to refund or exchange items that appear to have been worn, washed, or are not in original condition.
• We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

15. Product Description

We try to describe and display our Services and Products as accurately as possible. While we want to be as clear as possible in explaining our Service, you should not accept that the Site is entirely accurate, current, or error-free. From time to time we may correct errors in pricing and descriptions. We reserve the right to refuse or cancel any order with an incorrect price listing.

16. Intellectual Property Rights

Our Site and Service contain intellectual property owned by SweetDreamz By MKB, including trademarks, copyrights, proprietary information, and other intellectual property. You may not modify, publish, transmit, participate in the transfer or sale of, create derivative works from, distribute, display, reproduce or perform, or in any way exploit in any format whatsoever any of the Site or Service Content or intellectual property, in whole or in part, without our prior written consent. We reserve the right to immediately remove you from the Service, without refund, if you are caught violating this intellectual property policy.

You may not use our trademarks in connection with any of our Products or Services in any way that may confuse our customers or the public at large or in any way that harms SweetDreamz By MKB or their reputation or standing. Any other trademarks not owned by us belong to the Producers and affiliates associated with SweetDreamz By MKB and their ownership rights must be respected.

17. Change of Terms

We may at any time change these Terms and Conditions. Such amendments are effective from the time we have posted the new Terms and Conditions on this Site. Any use of the Site or Service by you after these Terms have been posted means you accept these amendments. We reserve the right to update any portion of our Site and Service, including these Terms and Conditions, at any time. We will post the most recent versions to the Site and list the effective dates on the pages of our Terms and Conditions. We advise you to check these Terms and Conditions at regular intervals.

18. Termination

You agree that we can terminate your use or access to this Site or Services at any time without notice if you violate any of these terms and Conditions. The duration of the contract for the sale of our Products is until performance has been completed by both parties. This agreement can be terminated at any time for any reason by mutual agreement.

19. Limitation of Liability

You agree that in no way will we be liable for direct, indirect, incidental, consequential or any other remedies as a result of using our site or Services. Additionally, SweetDreamz By MKB is not liable for damages or remedies for website failure, error, omission, attack by hackers or pirates, interruption, delay in operation or transmission of videos, computer virus, or system failure; third-party theft of, destruction of or unauthorised access or alteration or use of your information or personal data, whether we were negligent or not. This applies even if SweetDreamz By MKB has been advised of the possibility of something or could have foreseen loss or damage.

The laws of some countries do not allow some or all of these limitations. Some of these limitations may not apply to you and you might have some additional rights.

We are not liable for any delay or failure to comply with our obligations connected with our Services, Products or this Site if the delay or failure was beyond our reasonable control. Your right to have your Products sent to you within a reasonable time is not affected. You will not be charged for Products if the delay occurs before the Mailing Service dispatches your products. You may cancel your order at any time before the Product is sent to you.

20. Third-Party Links

Our Site and Service may contain links to third-party websites and resources. You acknowledge and agree that we are not responsible or liable for the availability, accuracy, content, or policies of third-party websites or resources. Links to such websites or resources do not imply any endorsement by or affiliation with SweetDreamz By MKB. You acknowledge sole responsibility for and assume all risk arising from your use of any such websites or resources.

21. Right to Take Action

If we do not take action because you have broken a clause in these Terms and Conditions it does not mean that we will not be able to use our rights in any other situation where you breach these Terms and Conditions or other legal responsibilities or duties you have to us.​

22. Indemnification

You agree to pay us for any losses, damage, settlements, liabilities, costs, charges, assessments, and expenses, as well as third party claims and causes of action, including, without limitation, lawyer’s fees, arising from any breach by you of any of these Terms and Conditions, or any use by you of the Site or Service. You will provide us with any help that we might ask for in connection with any such defence without any charge including, without limitation, giving us such information, documents, records, and reasonable access as we see necessary. You will not resolve any third-party claim or reject any defence without our previous written permission.

23. Headings

The subject headings of the paragraphs and subparagraphs of this contract are included for convenience only. They do not affect the construction or interpretation of any of its provisions.

25. Entire Agreement

These Terms and Conditions including the Returns Policy and any attachments are the whole agreement between SweetDreamz By MKB and you and cancels all other verbal or written understandings concerning this agreement which were made outside this agreement. SweetDreamz By MKB state that they are not liable for any misrepresentations they made before and outside this agreement.

26. Reliance on these Terms

We intend to rely on these written Terms and any document expressly referred to in them about the subject matter of any agreement between us. We and you will be legally bound by these Terms.

27. Events or circumstances beyond our reasonable control

If we are prevented or delayed from complying with our obligations under these Terms by anything you (or anyone acting on your behalf) does or fails to do or due to events or circumstances beyond our reasonable control, our inability or delay in performing our obligations will not be in breach of this agreement. Examples of such events and circumstances, but not limited to, include fire, flood and other natural disasters, strikes, trade disputes, lockouts, restrictions of imports or exports, riot, accident, disruption to energy supplies, lockdowns, pandemics, civil commotion, acts of terrorism or war.

28. Severability

If an appropriate court or arbitrator decides that a clause or condition in this contract is invalid or it conflicts with a law, the invalid clause can be cut from this agreement leaving the rest of the agreement valid and unaffected.

29. Assignment

This agreement or any clause in this agreement cannot be assigned, delegated, sub-licensed, or transferred by you unless we have given you written permission.

30. Governing law

You agree that any dispute or claim arising out this agreement or in connection with its subject matter or formation, including non-contractual disputes or claims, will be governed and interpreted according to English Law. You also agree that English courts have exclusive jurisdiction except for negotiation and mediation resolution described in clause 28 below.

31. Dispute Resolution

Any dispute relating to this Agreement, which cannot be resolved by negotiation between the parties within 14 days of either party giving notice to the other party that a dispute has arisen, can be submitted to mediation by a mediator mutually chosen by the Parties and that the mediation or negotiation will be conducted online in English using an accredited mediation service. The initial Mediation cost only is to be shared equally by SweetDreamz By MKB and you. However, this does not cancel out clause 34 below which applies to all other legal costs. Failing settlement of that dispute within 14 days, the dispute shall be submitted by any party for a final decision to an English court which will have exclusive jurisdiction.

32. Recovery of Legal Costs

If any legal action or any arbitration or other proceeding is brought for the enforcement of this Agreement or because of an alleged dispute, breach, default, or misrepresentation in connection with any of the provisions of this Agreement, the successful or prevailing party or parties shall be entitled to recover reasonable lawyer’s fees and other costs incurred in that action or proceeding, in addition to any other relief to which it or they may be entitled to.
